Wifi works just fine on the phone, no need for cell service for that.

Small claims court is for monetary relief. You spent money and it was not returned to you do to a defect, or over charged, not because it (the phone is not in the Verizon database) on Verizon.
In cases like this "IF" you can get an attorney to take your case which I doubt it will cost you first the lawyers fees, the superior court fees, the filing fees, and you have to have case law to back up your issue with the court.
Because the EMEID is listed as lost or stolen or not in Verizon's database is not cause for a court case.
Additionally Verizon can not allow your device on their network if they so desire. So you are in a "gotcha" right there.
