I have noticed that if you are in an active call (that was an incoming call) and you receive another incoming call (putting you first call on hold) you can not merge the calls. If you receive and incoming call and place an outgoing call as the second call it works fine, but not in this order. It appears this has been an issue for several years. Is there any reason it has not been fixed.

That's a limitation of CDMA network technology used by Verizon & Sprint, you'd have to be the initiator of both calls to merge them. GSM networks like AT&T/T-Mobile can merge incoming calls.
