How do I get Verizon to honor unlimited data plan stated on receipt?

I was among those who upgraded their phones during the "glitch" that allowed customers to keep their unlimited data plans. Our two new iPhone 5s' arrived this week, along with receipts for each that, as far as I can tell, maintain our unlimited data plan.

When I called to activate the phones, the rep told me he couldn't guarantee we would keep the unlimited plans after activation, and the activation (along with the potential change to the 2GB plan) was irreversible. I asked to speak to a supervisor, who told me we still have the option for unlimited data and that it was just our luck of the draw. I took this to mean we lucked out with the glitch. However, when the rep got back on the line he said the supervisor meant that when he (the rep) activates our phones, it will kick us to the 2GB plan, and he may be able to switch us back to the unlimited if he acts fast enough, but it was no guarantee (hence "luck of the draw"). I decided to not act just yet and got off the phone.

So, is the rep pulling my leg? I understand I got to this point through what was later revealed to be a glitch, but I thought Verizon stated to the press they would honor the orders, not to mention I have receipts showing the new phones and our current plan that we've had for years.

How should I proceed with this? Thanks for any help.

I was finally able to speak with someone at Verizon cognizant of the circumstances, and she was able to help me out.  Guess it's all a matter of talking to the right person, because no one I spoke with prior to that had a clue of the issue. Thanks all for the advice!

The one way is to contact a lawyer or take verizon to court. Find the news article that stated that those who ordered on that weekend could indeed keep their unlimited. Your receipt also shows when you ordered so that will also cover you.

Verizon can over ride account actions. Don't let them tell you that you cannot.

I believe you can just swap out meid numbers for each device from my verizon. I know I had done it in the past when I buy my phones at full price. I switch out the esn/meid/emid number from my new device over my old device.

Good Luck

one way is to activate your new phones with your existing simcards instead of the new simcards that the new phones came with.

if you feel like dealing with mediocre customer service

call again and direct whoever is on the phone to the press release.

Thanks for the advice. I think I'll try taking our phones to a Verizon store, receipt/contract in hand, and see if they can help. I'll have the articles ready too.

I don't agree with you there Elector. Even if it was in the media doesn't mean much. It would if it was a special they were running to get existing customers to upgrade. But it wasn't. It was a glitch, simple as that. I'm actually surprised they even told you that it will probably change to the 2GB plan. And if the order went through completely they would honor it but if the system caught it during the order process then there is not much you can do. At least they didn't complete the order with the 2GB plan. If you wanna push for it a corporate Verizon store would be the way to go. They hate customers making a big scene when potential customers are in store. I hope it'll work out for you but I highly doubt it.

Fortunately in all my dealings with the court system "written" takes a great sway over intent. You have someone sell you a service and they write this order is final with the additions etc. Then on the day the goods or services are provided the company states this was not supposed to be agreed to (intent) the contract is based on what was written and agreed to.

I am presently locked into a simular situation now with a home improvement contractor. On the contract it stated the job must be completed no later than October 13, 2013 or sooner. Its signed by them and us. Now they missed the contract date, they are claiming the agent for the company had no right to do so. They keep pushing the date further and further away.

Went a filed a court claim for the large money we paid plus simple interest on the amount. Also found another company who will do the job now at a cost $4,000.00 more than the other company. In my state the court can grant me either as relief. Also not doing the job is criminal in nature so we can file a police complaint for grand larceny. Bad business practice.

Evidently the company was served with the summons last week. Since they called and said the work will be done complete Tuesday, Wednesday and Thursday.

They have to honor what was written. Same thing with Verizon via their press release.

I remember years ago an online retailer had a typo in their ad, the price should have been $250 but the printed ad said $25 in that case the companies ad had a disclaimer which said not responsible for typographical errors. In this case verizon had no such disclaimer at the check out process.

Wise words. If they have the receipt showing no changes to the plan then they would win in court. On the receipt he said "along with receipts for each that,as far as I can tell, maintain our unlimited data plan." so if that receipt does not express the data plan would remain the same, they would only have proof based off what the rep told them. The rep told them "luck of the draw" on whether or not it will remains so Verizon did not say they would or wouldn't. Benhar, if that receipt shows that your data plan would remain, call that lawyer Smiley Happy if not, well you don't have anything in stone saying you could keep it.

I upgraded my wife's phone during this glitch.  When I went to active her new iphone 5s it would not and I had to call in.  When I called in they activated it and switched over my phone to 2gb of data.  I told them that there was a "glitch" when I ordered it and I had a screen capture of my order.  I also told the rep that verizon had come out and said that they would honor any phones purchased during this "glitch".  I told him that I would just return the phone to my local verizon store and just keep my unlimited data if they did not honor the purchase.

The rep went away and then came back saying that he had moved the data back to unlimited from 2gb.  He also said that if it was changed to 2gb and then I noticed a day or two later, he would not have been able to change it back to unlimited.  I also told the rep to just Google "verizon glitch" and the first article that comes up would tell him everything he needed to know about the glitch if anyone else calls in.

FWIW, I also went to a local store and asked about upgrading my phone(sadly I did not upgrade mine during the glitch), and they knew nothing of this glitch either.  I am surprised that very little people even knew about it.
