is not as good as it could have been. There is a BIG difference between "we can replace this via warranty as a defect" and "we will replace this via warranty as a defect"

You're right and I hope they do! At least they are recognizing that they CAN in fact make a warranty claim in this situation.

I agree with Elector. Verizon is the middle man when it comes to phones. They sell them yes, but it's not a Verizon phone. Wouldn't you agree the Galaxy S4 is a Samsung phone? Or is it a Verizon Galaxy S4? I like making comparisons to other situations so here is one. If you go to walmart and buy a box of cereal, you get home and pour a bowl and a bug comes out. Would you assume resposibility to Wal-Mart or to the cereal company. Sounds like you would demand Wal-Mart to recall the whole brand........which they can't do. As a matter of fact there is a NUMBER on the back of the cereal box to call for a complaint!!!! What I'm saying is that no matter where you bought any product. It's the company that makes that product that is at fault.

However this would not be a fair comparison. The bug could just as easily have gotten in the cereal while the box was sitting in the Walmart store as it could have from the manufacturer. Walmart would have happily accepted the box for return.

If I bought a box of cereal from Walmart and found a bug in it I would take it back to Walmart and expect a replacement. Now, if there were a news story or blog where lots of customers were saying they found bugs in their cereal then yes, I would expect them (as would the FDA) to recall the lot.

The grocery scenario is a great analogy Smiley Happy In fact, I have bought things from the grocery store that were bad and returned them with no problem. I bought cheese from stop and shop last year and when I got it home there was some white material (maybe mold) all over it. I went back to the grocery store, handed them the cheese, and they handed me a refund. I didn't contact Kraft because then I would have to wait too long for a refund or coupon.

You are totally right! And further, if the bug got in the box of cereal while it was sitting on your shelf at home they wouldn't be able to determine that either. Yet Walmart would STILL accept the return to satisfy the customer.

My apologies. I didn't mention it was inside the bag, not the box. Which would have meant it would have been shipped that way.That was a bad analogy.  But I was just primarily getting at if there is something wrong you would call the product maker. Another scenario would be if you bought a Ford at a 3rd party dealer and there was a known issue with the cooling system verified by Ford. It wasn't a big enough issue where they recalled the model but it was a problem with that model. Ford would be the ones to talk to and fix/replace the system. Not the 3rd party you bought it from since it was a known issue with that Ford model. Hope that scenario is better

Yep you got me confused with that one. ha ha

A little point to ponder even though I know what you mean.

I buy a car from Ford Dealer or any other dealer. There is a cooling system problem, there is a TSB on the issue but most times the dealer won't tell you about the bulletin. It costs them money to fix the issue.

Now the  Safety Board in Washington DC makes Ford, or Lexus, or Chevy aware of the issues and tells them to fix it. The maker as you stated has to fix the autos. The local dealers and garages can do the actual work but the maker of the cars pays the invoice.

But most times the customer knows nothing about the defect, or problem even though the seller is fully aware of the problem.

Say Samsung has glass breakage issues, Verizon sells the units knowing this and then sells them anyway. Since Verizon does not repair the devices, that would leave Samsung on the hook. But if Samsung tells their sellers not to acknowledge the defect, the poor customer gets the short end of the stick.

The makers are responsible, but will not say so. They rather have you the consumer just have to buy another phone.

Profit, Profit, Profit must be maintained.

No need to apologize, I appreciate your comments.

It's funny you should bring up the car situation because I used that analogy when I spoke with Verizon.

If I buy a car from an authorized dealer (but not the manufacturer) and the car turned out to be a lemon I would expect that the dealer would replace the car. I would not expect to have the car shipped off to the manufacturer headquarters or repair center and wait for repair or replacement. Even more so, I would not expect to have to file a claim with my insurance company (which is what they keep pushing) as that would be totally inappropriate.
