This is something I have been wondering about myself. When Verizon wrote their Terms of Service, I am sure that rooting and jailbreaking were grey area topics.
However, in August of 2010, the US Patent Office ruled that Jail Breaking and Rooting did not violate the Digital Millennium Copyright Act.
If an agent of the US Government ruled something was legal, then how can Verizon keep saying it violates their TOS?
I want to make it clear that I am not encouraging anybody to mess around with their phones, I really am looking for answer to a question.

Legality has absolutely nothing to do with it. Having to support phones with unofficial firmware would be a customer service nightmare (their reps hardly know anything about how to use the phones as they are), not to mention the possibility of bricking your phone through a bad flash. This is why it voids your warranty, and is against the TOS of this site to discuss it. Same thing with swearing and personal attacks against others, not illegal, but against the TOS of the site.

If Verizon isn't going to upgrade to ICS, and it appears they are not, then the answer is to demand an Incredable 4G LTE as a replacment. If no luck then small claims court is a place to go for redress.

They are both good phones and I paid top dollar for my Rezound with the assurance that ICS would be available in the first part of 2012. July is not the first part of 2012. This gets into a a sense of equity and not being told the truth by a company I'm doing business with. I sense arrogant disregard. A large demand for replacement phones would get their attention. It already has cost them a small amount of money. When I bought my iPad I chose AT&T because of my dissatisfaction with the ICS situation.

good thought rhino. I think everyone should do as I am going to. Register a complaint with BBB. forward complaint to the attorney general of each ones state. demand release from the 2 year contract for fraudulent sales marketing. Verizon's failure to address its customers with responsible, no change that to respectable answers is the most offensive business practice I have ever witnessed, and paid employees like tidits remark about "oh good luck winning that in court" further demonstrates this companies blatant negligence. How many businesses have to grovel for customers to keep their doors open. But not Big Red they have us locked in already.Well I will be writing my congress reps to begin debating legislation that addresses this 2 year contract situation. Our congressmen's constituents deserve a forum for addressing this type of corporate negligence, and some CEO deserves fired. I'm sure the rest of you cubicle jockeys will be following up my post with your companies approved methods of belittling those of us that have a right to complain, but save it. I've already seen all your tactics and personally have become quite worn on your disrespectful whitewashing.

The only Verizon employees on here are labeled as such. They all sign in under the Verizon Customer Service account (or have _VZW on their personal login) and, AFAIK, are only low-level tech support personnel. And, nobody said you didn't have a right to complain, but this is a peer-to-peer forum intended for users to help other users having issues with their devices (and not having an update is not an issue with the device). Not to mention the myriad of threads that always pop up about this very subject. It gets irritating having to sift through them to find users with real problems.

LOL They have people "locked in" over 300 bucks? Sorry, we're living in an economy where we have no shortage of people who have 150K plus bad mortgages and are walking away when they're under water. Nobody is locked into jacksquat.

perhaps you neglected to read the thread subject line demmo. how is it that you feel a forum is solely for ptp support issues. also, you, tidbits,and a few others recieve payment either directly or indirectly from Verizon, verified by logic, noone would spend the hours day after day defending and whitewashing issues as your group does without an incentive..If i'm wrong in this assumption then you people have issues. So why don't you define that incentive to us.
