Or you talking about the press release from HTC or Verizon that was based on a projection saying these devices you get it STARTING early 2012 with no hard dates on which devices would get it first and which would be getting them last? So exactly where did it say the HTC Rezound would be getting it sometime before June?  When HTC has already shown June/July on their projected update date which is also subjected to change in their disclaimer.

Tidbits...  Here is the third page of the November Press Release announcing the Rezound.  Since the last time I uploaded this page, I just added a red box around the section titled Operating System.  It has a one sentence description.  It says, "Android 2.3 (Gingerbread) with latest HTC Sense an upgrade to Android 4.0 (Ice Cream Sandwich) will be available in early 2012."

The release doesn't say starting in, maybe, possibly or coming soon.  It says will be and from what I remember from my schooling, will be is a definitive statement marking a point in time.  Now Early 2012 is a somewhat vague statement and some here have defined it to mean no later than March.  I am a reasonable individual.  I might have defined it as April 2012.  To me thats still early in the year.

It also says 4.0, not 4.0.3 whose code was released after Google put out the initial ICS Code.  We should have gotten 4.0 and then incremental upgrades to 4.0.1, 4.0.2, 4.0.3, and 4.1 (Jelly Bean).

This is why I am annoyed with Verizon.  This update should have been on our phones a long time ago and we could have been enjoying incremental updates as necessary.  Similar to the Galaxy Nexus.

One last thing, show me on that page where it says the release date for ICS is only projection.  I will give you a little hint... its not on any of the pages.

When I go to work (at the Steel Mill) and look at my work schedule, management actually has a clause at the bottom of the schedule that says times and days are only a framework and are subject to change on market conditions.  There have been weeks where I have worked with no day off, but that little clause protects management from a grievance being filed.

If Verizon & HTC could not have met the stated terms of the press release, then they should not have included it or simply put Ice Cream Sandwich coming in 2012 or coming soon.  That is a completely vague statement and would give us no reason to crow about the update not being here yet.

Wish they'd go ahead and release the update.  Then people can get to complaining about it breaking their phone or and/or asking where's jelly bean.

Tell me about it. I for one just wish it was over with now. I know we'll never hear the complaints stop but it'll be something different.

And you'll have it, "when available"

I still don't see a promise or a hard date.  Good luck making that stick in court if you ever tried. Before anyone says anything...  This has happened through the court system multiple times(not always about cell phones), and manufacturers won all the time when there isn't a specific date, and beyond reason(dependent on judge but it's 3 to 6 months from initial projection) was never met.

recent devices that were in a lawsuit over some sort of update.

Samsung Behold II (2.0 but ended up getting 1.6)

AT&T and MMS for the iPhone(gosh really? This one really boggled me)

HTC Vivid I believe for AT&T.

All of those met the within reason clause

Well it seems to me that selling a device and a service the fundamentally does not work is consumer fraud.  I'm paying for hotspot and 4G and I'm getting neither.  I've been through three phones and I still don't have one that does what they say it will/can do.

I live in California and I think an Attorney General complaint is the way to go.

Posts here have not been edited due to referencing ICS as a fix, but the method in which this was discovered.  Posts suggesting hacking or installing a leaked version of the OS as a fix are against the TOS of this forum and will always be moderated.  There are other sites where these things can be discussed, and you will have to go there to do so.
